Three adolescents originating from Fécamp (Seine-Maritime) were placed in police custody after the broadcast, Wednesday, May 1, 2019, of a sextape of a young girl on the social network Snapchat. Among them, the victim’s boyfriend, author of the sequence in question.
Victim’s boyfriend arrested
It was therefore Wednesday, May 1, 2019 that the victim, a 14-year-old girl, came to file a complaint. In question, the broadcast of a video of her “of a sexual nature” on Snapchat. “It was posted on an account in the Le Havre region”, specifies a judicial source.
The next day, her boyfriend and author of the video in question, a 16-year-old teenager, was arrested and taken into custody.
Cell phones analyzed
During his hearing, he nevertheless denied the facts, ensuring that he was not at the origin of the publication. According to him, the video was posted by his former girlfriend, jealous of his new relationship, and another teenager. Both were also arrested and taken into custody.
Still in progress, the investigation will continue by analyzing the phones of the three young people to determine the origin of the publication.
Dissemination of intimate images on the networks: what does the law say? Articles 226-1 to 226-8 of the Civil Code specify that: « Is punishable by one year’s imprisonment and a fine of 45,000 euros the fact, by means of any process, intentionally to invade the intimacy of the private life of another […] by fixing, recording or transmitting, without the latter’s consent, the image of a person in a private place. »
In October 2016, the Lemaire law reinforced these provisions, adding article 226-2-1 which increases the penalties incurred to a fine of 60,000 euros and two years’ imprisonment. But above all, it introduces into the law the compulsory agreement of the person in the distribution of a photo or recording of a sexual nature.
